To keep this policy transparent, we explain the most important terms according to Art. 4 GDPR:

  • Processing: Any handling of this data, such as collection, storage, use, or deletion.

  • Controller: The person or entity that decides why and how data is processed (in this case, us, Thinkubator).

  • Processor: External partners (e.g., website providers or cloud providers) who process data on our behalf and according to our instructions.


3. Legal Basis for Processing

We process data on the basis of the following legal grounds (Art. 6 GDPR):

  • Consent (lit. a): You have given us your consent (e.g., newsletter registration, cookie banner, or occasional declarations of consent for images).

  • Performance of a Contract (lit. b): The data is required for the fulfillment of a contract or for pre-contractual measures (e.g., project inquiries).

  • Legal Obligation (lit. c): We must store data due to laws (e.g., accounting).

  • Legitimate Interests (lit. f): We have a legitimate interest in the security of the website, increasing efficiency through modern tools, and public relations.


4. Website Technology: Hosting and CMS

Our website is operated using a modern builder system (Wix.com Ltd.).

  • Hosting: The provider hosts our entire website including all content. Upon visiting, technical log data (IP address, browser type, timestamp) is processed.

  • CMS & Downloads: All documents that we offer for download are stored in the provider's infrastructure.

  • Newsletter: Registration and distribution of our newsletters take place via the integrated services of the website system.

  • Data Security: We make every effort to protect your data and have concluded corresponding Data Processing Agreements (DPA).


5. Use of Modern Language Models (AI)

To optimize our internal processes and communication, we use modern AI technologies and language models within our work environment.

  • Type of Analysis: Emails sent to our domain may be analyzed by machine to create summaries or speed up processing.

  • Special Regulation office@thinkubator.earth: We have deactivated all available "smart features" and additional AI functions at this central address, as far as technically possible. Here, only standard processing by the mail provider takes place.

  • Data Location: We make every effort to prioritize processing within the European Union (EU) (primary storage location set to EU since February 2026).

  • Configuration: We have configured our systems to the best of our knowledge so that your data is not used for training the providers' public AI models (opt-out).

  • Objection: You have the right to object to the AI-supported analysis of your communication at any time.


6. Special Processing Activities

  • CRM Metadata: We maintain an internal system for managing business contacts. In this process, metadata (sender, time, subject) is recorded. The content of emails is not stored in this specific system.

  • Photos & Videos: At our events, we take recordings for documentation and public relations. For this, we obtain separate consent from the persons concerned on a case-by-case and situational basis.

  • Personnel Management: The processing of sensitive documents within the framework of employment relationships takes place in personal coordination with employees after prior instruction.


7. Third-Party Services

  • Fonts: For uniform presentation, we integrate external fonts (e.g., Google Fonts). For technical reasons, your IP address is transmitted in this process.

  • Video Integration: We integrate videos from external platforms (e.g., YouTube). When played, cookies may be set by these providers.

  • External Links: Our website contains links to external sites. We are not responsible for their data protection.


8. Cookies and Analysis Tools

Our website uses cookies. We distinguish between technically necessary cookies and cookies for marketing or analysis purposes.

Necessary Services First and foremost are the Website Essential components, which are strictly required to ensure the basic security and functionality of the platform. These are supplemented by Consent Management, which is also classified as necessary as it manages your individual consent settings.

Optional Services for Marketing and Analysis Beyond the basic functions, video content from the Marketing category is used; these not only enable the playback of videos but may also record your preferences. Finally, Web Analysis serves to create anonymous statistics about the use of the website. It is important to note that this analysis service only becomes active if you have previously given your express consent.

  • Creation of anonymous statistics on website usage (only after consent).

  • You can adjust your cookie settings at any time via our consent banner or delete them in your browser settings.
